I just want to say that i have an appointment with my solicitor on Wednesday afternoon. Its my intention (provided Kevlar has finished the documentation by that time) to take everything along and get a clear understanding from a legal point of view were we stand as to Criminal / Civil proceedings and also obtain an outline of advice as to where we should move from that point.
Regardless of if refunds come through or not i personally see this as a necessary next step forward
If indeed this is a criminal matter (which i strongly suspect it is), we already have members in Ireland that have agreed to take the information to the local police for us.
We might find that both Civil and criminal proceedings can be bought forward in this case.
After my meeting with the solicitor its my intention to forward the advice received to Kevlar who will then co-ordinate the next steps

[/quote]I will have, and I’d be happy to provide it to your lawyer directly, who can share it with you if he sees fit to do so (I’m sure he will). It will contain the findings of everyone, including screen shots and ip addresses and all facts as has been sent to me in numerous PMs my many people.
I’m also speaking to Shane directly now, and it’s my intention to get this all resolved before such means become necessary. If we can settle this without involving the justice system, that would be preferable, because I can assure you that in the case of criminal action, the only people who will win are the lawyers. Your lawyer will tell you the same thing: The best outcome you can hope for is an out of court settlement. I’ll still give your lawyer the docs if you want to pursue that.
Regardless of what happens next, I’m working hard this weekend to organize this all and work things out in a way that benefits everyone.

As for refunds, the best solution I can offer you is a percentage of the refund proportionate to your contribution at the time of it. So if you supplied 10% of the funds as calculated by the exchange rate at the time of the payment, and we get back 90% of the funds, you can expect to get back 10% of the total collected funds, which is 90% of your expenditure, and 9% of the total amount taken. This is the only fair way to do it that I can think of, because it assumes that the transaction was priced at the time it was made, and a proportionate refund means no penalties/rewards for using another currency. Of course if we get FTC, we’ll send FTC, but if we only get BTC, then you’ll just have to accept the difference in price between now and when you made the purchase, and I’m sorry about that, but I can’t give more to some people just because the exchange rate has changed. The refund worksheet will make this all clear.
I’ll be announcing hard [u]DATES[/u] by the [u]end of this weekend[/u] of when and how the rest of my effort will go down. We need deadlines to ensure everyone has time to participate and claim their refund, and get all the parties organized, because it very well may be the case we need to do a partial refund, and if that’s the case we need to know how much to send to who. It’s not fair to just keep saying, “We’re working on it”, so dates of when you can expect to get your money back are real important in my mind, and allows for transparency, while still giving everyone time to organize and communicate.

However, it has to be apparent to Shane that if a single payment date is missed, legal/criminal action will proceed. One thing that has been shown to everyone here is that Shane can not be trusted in anyway what so ever! It’s more then possible he is taking advantage of the good nature of the community once again to stall and try and get away with it.
If any agreement is made there must be consequences for failure of Shane to deliver his end of the bargain, It only worsens what is already despicable behavior from Shane if he fails to deliver on any more promises made herein.
I will still proceed with the appointment with the solicitor as i believe its in everyone’s best interest that invested in scryptcloud.com - if anyone who invested disagrees with that then please let me know.
I have no problems in anyway covering the legal costs for this initial advice as we should all be very cautious of any further dealings with Shane. At the moment i am very confident this is a criminal matter but need to understand how that would be affected if we entered into a voluntary agreement with him. Criminal proceedings should never be removed from the table until this matter is resolved. I also think that any refund proposal or agreement made with Shane should be backed up with legally binding paperwork that he himself signs. That being said, Shane should provide you with the contact details for his solicitor for that paperwork to be forwarded to when the time arrives.
I personally am not prepared to enter into any kind of agreement with Shane purely based on his word alone. I feel confident that no-one else will want to do that either. Again if i am wrong, please let me know
I will speak with my solicitor on Monday and PM you her email/contact details for you to forward the information to.
This situation is far from over, but at least things seem to be moving in the right direction for the time being

Well I’ve got some unfortunate news.
First of all the 8.885 BTC appears to have been unrelated, and tied to YET ANOTHER scam. At least according to FTClover. I’m still investigating.
The really unfortunate news is that FTClover has officially taken the money and run. He refunded one person 120 euros, but beyond that, I don’t expect to hear anything from him. So the refund worksheet is a little less important now, and getting the dox together takes the priority. I’ll be completing it this weekend.
He has admitted several things to me which might be of some interest:
#1: He never ordered any hardware at all. Ever.
#2: He used the money to pay off bank debt, so there’s a paper trail.I’ll be putting these details into my official report.
You have on your hands the potential for a class-action lawsuit for international wire fraud and theft. I’ve done my best to avoid that possibility, but at this point it seems inevitable.
For everyone who was taken by this, I’m very sorry. I hope you’ll continue to pursue legal recourse, and you won’t let this impact your opinion of the rest of the community, or the technology that is Feathercoin.
